To set up a DUI roadblock, a police department must first prove that it is necessary. A large number of DUI arrests at a specific location may be cited as proof that the roadblock is needed. A supervising officer must then approve the DUI roadblock in advance—roadblocks cannot be set up spur of the moment.
To maximize the deterrent effects of a DUI roadblock, it must be publicized in advance. This can be done through radio spots, the newspaper, or the police department’s website. While the roadblock is being conducted, it must be visible to oncoming traffic by signs, lights, patrol cars, and the presence of uniformed officers.
Before the roadblock starts, the officers must decide on a pattern for stopping cars. This could be every car, every other car, or every fourth car. When an officer pulls over a vehicle, he or she will look for signs of intoxication, such as the smell of alcohol, slurred speech, or bloodshot eyes. If the driver exhibits any of these signs, the officer may ask him or her to step out of the vehicle to perform a series of field sobriety tests.
If a driver fails any of the field sobriety tests, he or she may be asked to take a breathalyzer in a mobile unit or transported to the police station for the test. The breathalyzer test is designed to measure blood alcohol content (BAC). In Georgia, the legal BAC for drivers over 21 is .08%, while the limit for underage drivers and commercial vehicle operators is much lower (.02% and .04%, respectively). If a driver tests over the appropriate legal BAC limit, he or she will be charged with DUI.
